Aix\u00f2 implic\u00e0, per exemple,\nla represa de l\u2019activitat normativa a l\u2019\u00e0mbit europeu, amb\nl\u2019aprovaci\u00f3 de la directiva sobre salaris m\u00ednims adequats <a href=\"https:\/\/memoriacesib.es\/2022\/4-les-relacions-laborals-a-les-illes-balears\/#15\"><span style=\"color: #01a1df;\">(15)<\/span><\/a>.<\/p>\n<p style=\"font-weight: 400;\">Tamb\u00e9 \u00e9s l\u2019any de l\u2019entrada en vigor la reforma laboral, la garantia d\u2019estabilitat en\nl\u2019ocupaci\u00f3 i la transformaci\u00f3 del mercat de treball, la qual suposa la primera reforma\nlaboral de gran abast de la democr\u00e0cia que s\u2019aprova amb el consens dels agents socials i\nque afecta diversos punts molt rellevants de les relacions laborals <a href=\"https:\/\/memoriacesib.es\/2022\/4-les-relacions-laborals-a-les-illes-balears\/#16\"><span style=\"color: #01a1df;\">(16)<\/span><\/a>.<\/p>\n<p style=\"font-weight: 400;\">En concret, pel car\u00e0cter estacional de bona part de l\u2019activitat econ\u00f2mica de la CAIB, a\nefectes de l\u2019an\u00e0lisi de la negociaci\u00f3 col\u00b7lectiva, esdev\u00e9 particularment important exposar\nels canvis introdu\u00efts en mat\u00e8ria de contractaci\u00f3 temporal per millorar la qualitat del treball\nde durada determinada, garantir l\u2019aplicaci\u00f3 del principi de no discriminaci\u00f3 i establir un\nmarc per impedir els abusos derivats de la utilitzaci\u00f3 de contractes temporals successius.<\/p>\n<p style=\"font-weight: 400;\">Es modifica l\u2019article 15 de l\u2019Estatut del treballador (ET), que estableix les causes que justifiquen\nla contractaci\u00f3 de durada determinada i les noves regles sobre la concatenaci\u00f3\nde contractes temporals en una mateixa empresa o grup. Cal destacar que desapareix la\npossibilitat d\u2019establir contractes per obra o servei determinat, una modalitat contractual\nque havia estat qu\u0308estionada i que s\u2019utilitzava de manera molt frequ\u0308ent, perqu\u00e8 la jurisprud\u00e8ncia\nn\u2019havia adm\u00e8s l\u2019\u00fas per a la contractaci\u00f3 de treballadors dedicats al compliment\nde contractes i subcontractes entre empreses. Ara nom\u00e9s es pot subscriure el contracte\nde treball de durada determinada per circumst\u00e0ncies de la producci\u00f3 o per substituci\u00f3\ndel treballador. I, a m\u00e9s, pel que fa al primer, se\u2019n prohibeix expressament la utilitzaci\u00f3 per\ncobrir treballs de contractes o subcontractes entre empreses.<\/p>\n<p style=\"font-weight: 400;\">En la modalitat del contracte per atendre situacions ocasionals, previsibles i que tenguin una\ndurada redu\u00efda, nom\u00e9s es pot contractar el treballador per un m\u00e0xim de 90 dies, necess\u00e0riament\ndiscontinus, a l\u2019any. Igualment, s\u2019estableix una nova redacci\u00f3 de l\u2019article 15.5 de l\u2019Estatut\ndel treballador per limitar encara m\u00e9s la concatenaci\u00f3 de contractes temporals.<\/p>\n<p style=\"font-weight: 400;\">Pel que fa als contractes fixos discontinus, s\u2019estableixen noves regles per a la gesti\u00f3 dels\nper\u00edodes de contractaci\u00f3 i d\u2019inactivitat, aix\u00ed com per als processos de reincorporaci\u00f3 dels\ntreballadors. A m\u00e9s, se n\u2019amplia el camp d\u2019aplicaci\u00f3, que fins ara nom\u00e9s es podien usar en\nels sectors amb activitat irregular.<\/p>\n<p style=\"font-weight: 400;\">Pel que fa, en general, a la regulaci\u00f3 de la negociaci\u00f3 col\u00b7lectiva, les mesures m\u00e9s\ndestacades de la reforma laboral afecten l\u2019estructura de la negociaci\u00f3 col\u00b7lectiva i el\nr\u00e8gim jur\u00eddic de la seva vig\u00e8ncia temporal. D\u2019una banda, s\u2019elimina la prioritat aplicativa\ndel conveni d\u2019empresa en l\u2019\u00e0mbit salarial, perqu\u00e8 es considera que s\u2019emprava com una\nmesura substitutiva dels mecanismes de flexibilitat interna per afrontar situacions\nconjunturals. A part, m\u00e9s que crear una unitat de negociaci\u00f3 nova, es comportava com\nun succedani de la inaplicaci\u00f3 del conveni col\u00b7lectiu. Tamb\u00e9 es considera que la regulaci\u00f3\nsalarial a escala d\u2019empresa afavoreix la compet\u00e8ncia de distintes companyies d\u2019un mateix\nsector al voltant d\u2019una reducci\u00f3 dels costos laborals. Aix\u00ed i tot, la prioritat aplicativa del\nconveni d\u2019empresa es mant\u00e9 en altres mat\u00e8ries com ara les jornades de treball, els horaris,\nla distribuci\u00f3 del temps de treball i el r\u00e8gim de treball a temps parcial.<\/p>\n<p style=\"font-weight: 400;\">D\u2019altra banda, la reforma laboral suposa la tornada a la ultraactivitat legal indefinida per\ndefecte dels convenis col\u00b7lectius. Per tant, les seves disposicions i condicions laborals es continuen\naplicant indefinidament despr\u00e9s de la seva data de caducitat. En altres paraules, el\nconveni continua vigent i en vigor, i les seves cl\u00e0usules i acords continuen sent vinculants\nper a les parts fins que se substitueixi per un nou conveni col\u00b7lectiu o es produeixi un acord\ndiferent. Tot i aix\u00f2, el r\u00e8gim legal continua sent dispositiu i, per tant, els agents socials encara\ntenen llibertat negociadora per fixar un r\u00e8gim diferent per acord expr\u00e9s, previst en el\nmateix conveni col\u00b7lectiu o en un instrument diferent propi de la negociaci\u00f3 col\u00b7lectiva.<\/p>\n<p style=\"font-weight: 400;\">Pel que fa en particular a la negociaci\u00f3 col\u00b7lectiva balear, en els BOIB de l\u2019any 2022 s\u2019han\npublicat 36 convenis col\u00b7lectius, quantitat que gaireb\u00e9 duplica els 19 del 2021 i molt\nsuperior als nom\u00e9s vuit publicats el 2020. Les darreres anualitats que s\u2019acosten a la xifra\nde 2022, s\u00f3n els 23 que es van publicar el 2019 i els 28 del 2018.
